PARTICIPATION RULES OF THE EVENT
- General provisions
1.1 This Regulation (“Regulation”) contains general conditions of participation in the event organized by Fundacja Old Music Live (“Organizer”) and is a part of the agreement concluded between the Organizer and the participant of the event.
1.2 In the event of loss and/or damage of tickets by the participant of the event, the participant has no right to claim compensation. In the event of leaving the venue by the visitor, the ticket becomes invalid.
1.3 By purchasing a ticket, the participant of the event confirms familiarity with safety rules, admission conditions, age restrictions, and other regulations. Failure to comply with the above regulations may result in the exclusion of the participant from the event without the possibility of compensation.
1.4 The ticket purchaser bears full responsibility towards Fundacja Old Music Live for any direct and proven damages caused by unlawful behavior or gross negligence. The responsibility of the ticket purchaser in the case of minor negligence is not enforceable.
2. Scope of the Organizer’s obligations, cancellation, and change of the event program
2.1 The Organizer’s obligations include providing a valid admission ticket holder to the event site (according to the ticket category) for participation in the event and providing organizational support for the event and its uninterrupted course. The event organizer undertakes to ensure the highest level of safety during its events.
2.2 The Organizer has the right to cancel the event without prior notice due to reasons for which the Organizer is not responsible. In the event of such a situation, the ticket holder is entitled to rights provided by law.
2.3 The Organizer has the right to change the date, place, and program of the event due to force majeure. Force majeure includes, in particular: natural disasters, declaration of national mourning, strikes or official ban on organizing mass events, and all similar events that were not initiated by Fundacja Old Music Live and that prevent the event from taking place. Additionally, the event may be changed due to reasons beyond the Organizer’s control, such as unfavorable weather conditions preventing the event from taking place, illness/disability or other objective causes beyond the Organizer’s responsibility, or cases where the change is necessary to ensure the safety, health, or life of the event participants.
2.4 In the event of the event’s cancellation by the organizer/artist, the nominal value printed on the ticket will be refunded provided that the ticket is returned to the pre-booking office where it was purchased/ordered no later than 30 days after the original event date.
3. Event safety
3.1 The Organizer reserves the right to: (a) Refuse admission to a ticket holder in cases justified by safety reasons. (b) In cases justified by safety reasons, demand that the ticket holder leave the event venue and take appropriate steps to enforce the order. This applies in particular to situations where the event participant disrupts public order, behaves aggressively, or violates this Regulation. (c) Refuse admission to the event site to ticket holders found to be in possession of weapons, wearing shoes with metal endings, and any other items that may pose a threat to the health and life of others. (d) In cases justified by safety reasons, change the seating/standing position of the participant. The ticket holder will then be refunded the difference in the ticket price. They will also have the right to withdraw from participation in the event with a refund of the whole or part of the amount for the ticket.
3.2 Bringing cameras, tablets, or other audio-visual equipment onto the event site and using them during the event is prohibited.
3.3 Bringing backpacks, purses, and any kind of hand luggage exceeding A4 format to the event site is prohibited. Additionally,the Organizer prohibits the bringing of laser pointers, all alcoholic beverages and intoxicants, as well as bottles containing drinks regardless of their size and the material they are made of.
4. Additional provisions
4.1 The event participant may be exposed to constant exposure to sound intensity that may cause hearing damage.
4.2 Children under the age of four cannot participate in organized events for health reasons. Children and adolescents aged 6-14 can only stay on the event site in the company of an adult. The Organizer assumes no liability for physical damages resulting from non-compliance with the mentioned age recommendations.
4.3 Official event-related gadgets are sold in a designated area accessible only to ticket holders.
4.4 The purchased ticket should be treated as the Organizer’s individual consent to enter the concert, which may be revoked at any time for reasons related to safety regulations.
4.5 Without the Organizer’s explicit and prior consent, the event participant cannot use purchased tickets and/or VIP packages in their advertising addressed to the general public or in the organization of lotteries with prizes that include mentioned tickets and/or VIP packages.
4.6 Reselling or attempting to resell a ticket at a higher price than printed invalidates the ticket. The Organizer reserves the right to prevent organized attempts to act unlawfully. As a result, purchasing dozens of tickets for the purpose of obtaining financial gain from resale, attempting to resell at a higher price than printed, or using the ticket in an unauthorized promotion may result in invalidating the ticket without the right to a refund and criminal liability described in Article 133 of the Code of Misdemeanours.
4.7 Outdoor events take place in all weather conditions. Any adverse weather conditions do not entitle to a ticket refund.
4.8 In matters not regulated by this Regulation, the provisions of the Act of 20 March 2009 on the safety of mass events (Journal of Laws of 2009, No. 62, item 504) apply to mass events.
